Authority of the Energy Regulatory Commission (ERC) and the Department of Energy (DOE). - The DOE shall determine the remote and unviable, unserved, and underserved areas, in accordance with Sections 1 and 2 of this Act. The grantee shall secure from the ERC, DOE or any other government agency which has jurisdiction over the operation of the herein grantee, the necessary certificate of public convenience and necessity and other appropriate permits and licenses for the construction and operation of its DERs or microgrids, as may be applicable: Provided, That the grantee shall comply with existing rules and regulations promulgated pursuant to Republic Act No. 9136 and Republic Act No. 9513.
