The Provincial Jail Service. -(a) The DILG shall, at least five (5) months from the commencement of the corporate existence of the new province, establish and maintain a secured, clean, adequately equipped and sanitary jail facility for the custody and safekeeping of prisoners, any fugitive from justice, or person detained awaiting investigation or trial and/or transfer to the national penitentiary, or a violent mentalliy ill person who may endanger oneself or the safety of others, as duly certified by the proper medical health officer, prior to the transfer of such person to a mental institution.
(b) The provincial jail service shall be headed by a provincial jail warden whose qualifications shall be as those provided under Republic Act No. 9263, otherwise known as the "Bureau of Fire Protection and Bureau of Jail Management and Penology Professionalization Act of 2004". The provincial jail warden shall assist in the immediate rehabilitation of individuals or detention of prisoners. Great care must be exercised so that human rights of these prisoners are respected and protected. and their spiritual and physical well-being are properly and promptly attended to.
