Protest Mechanism. - In all stages of the procurement process for the National and Local PPP Projects, the mechanism for protest shall be resolved in the most expeditions manner which shall not exceed forty-five (45) calendar days.
Unless otherwise provided in this Code, in no case shall a motion for reconsideration or an appeal from any decision by the PBAC, Head of Implementing Agency, or Department Secretary stay of delay the bidding process. No award shall however be made until a decision on any pending appeal is rendered.
