The City Zoning Administrator. (a) The city zoning administrator must be a citizen of the Philippines, a resident of the City of Talisay for at least three (3) years on the date of appointment, of good moral character, a holder of a college degree, preferably a member of the Philippine Bar or a civil engineer, or any related course from a recognized college or university. He must be a first grade civil service eligible or its equivalent and have acquired experience in related work for at least five (5) years immediately preceding his appointment.

(b) The city zoning administrator shall receive such compensation, emoluments and allowances as may be determined by law.

(c) The city zoning administrator shall administer and enforce the provisions of the Land Use and Zoning Ordinance of the City with the following specific powers and duties:

(1) To grant or deny, with or without conditions applications for the granting of exceptions and variances in accordance with the provisions of the Land Use and Zoning Ordinance;

(2) To issue certificate of locational viability;

(3) To issue certificate of locational clearance;

(4) To serve notice requiring the removal of any use in violation of the Land Use and Zoning Ordinance upon the owner, agent or tenant of the building, land or upon the architect, builder, contractor or other persons who commit or assist in any such violation;

(5) To call upon the city and/or provincial prosecutor to institute any necessary legal proceedings to enforce the provision of the ordinance;

(6) To monitor ongoing/existing projects and issue notice of violation (if any);

(7) To coordinate with the city planning and development coordinator in the implementation of the ordinance or on other related matters thereto;

(8) To call upon the station commander of the PNP or his duly authorized representative to assist in the implementation and enforcement of the ordinance;

(9) To report to the city development council and the sangguniang panlungsod of Talisay all the exceptions and variances granted so that the Land Use and Zoning Map can be correspondingly be updated and also a report on the program and problems encountered in the administration and enforcement of the ordinance, making the necessary recommendations thereon; and

(10) He shall head the zoning review committee as chairman.
