The City Jail Service. - (a) The DILG shall, at least five (5) months from the commencement of the corporate existence of the city, establish and maintain a secured, clean, adequately equipped and sanitary jail facility for the custody and safekeeping of prisoners, any fugitive from justice, or person detained awaiting investigation or trial and/or transfer to the national penitentiary, or a violent mentally ill person who may endanger oneself or the safety of others, as duly certified by proper medical health officer, prior to the transfer of such person to a mental institution.

(b) The City Jail Service shall be headed by a city jail warden whose qualifications shall be as those provided under Republic Act No. 9263, as amended, otherwise known as the "Bureau of Fire Protection and Bueau of Jail Management and Penology Professionalization Act of 2004". The city jail warden shall assist in the immediate rehabilitation of individuals or detnetion of prisoners. Great care must be exercised so that human rights of these prisoners are respected and protected, and their spiritual and physical well-being are properly and promtly attended to.
