Limitation on the Number of Trainees. - Except for enterprises implementing an upskilling program for their employees, no enterprise shall be allowed to have EBET trainees exceeding twenty percent (20%) of the total number of its regular employees: Provided, That any trainee in excess of the twenty percent (20%) threshold shall be considered a regular employee of the enterprise concerned: Provided, further, That the TESDA may increase the cap, if necessary, takig into consideration the capacity of the enterprise to implement the EBET Program based on the Training Plan and its track record in implementing EBET Programs.
